on the u.s. consulate in libya. the report says grossly inadequate security because of management failures is to blame. ambassador chris stevens of the bay area along with three other americans were killed in the attack. the report concludes there was no protest before the ambush. that's all part of the unclassified portion of the findings. the rest of the information is only for those with high level clearance. >> it's going up to senate and house assigned reading rooms like we always do with classified information. >> the report acknowledged that the siege was unanticipated and they found no cause for disciplinary action. >>> house speaker john boehner wants a house vote on his latest plan to avoid the "fiscal cliff." boehner's plan b would raise taxes on everyone making more than a million dollars a year while cutting spending to benefit programs like medicare. democratic leaders have already rejected that idea. president obama had been firm about higher taxes for everyone making a quarter million dollars or more. but now, he appears willing to raise that cutoff point to $400,000. >>> o

lawsuit. apple won the first round in august, when a u=s district court judge ruled that samsung would pay apple over a billion dollars in damages. that's not enough for apple our tech reporter gabe slate is here. case? >> 1.0 $5 billion was the verdict earlier this year. apparently that was not enough that hearing is still going on and the san jose and the judge said that she is likely to reduce that $ 1.05 billion.. fine... with her belief that the jurors could have underestimated the danger is implicated. the details of the verdict in the month of august. nothing has happened yet samsung has not paid one penny to apple. they have appealed this decision in hopes of a mistrial. the judge will have to decide if it is a mistrial or not. most likely it will not be and to go forward. however, it could be appealed. we will have to wait and see. otherwise, they are going to wait and see weather or not ... one thing i would like to mention is how consumers could be impacted. if samsung products could be prices are released. that is not unlikely but possible. let me show you video these samsung v
